1.TERM: These covenants are to run with the land and shall be binding on all parties and all persons claiming under them for a period of 30 years from the date of this instrument is recorded, after which time these covenants shall be automatically extended for successive periods of 10 years unless or until cancelled or amended, in whole or in part, effective as of the first day of any successive period after the expiration of the initial 30 year period by recordation prior to such effective date of an instrument signed by a majority of the owners of the lots in the subdivision agreeing to the cancellation or amendment.

2.ENFORCEMENT: These covenants may be enforced at law or in equity against any person or persons violating or attempting to violate any covenant, either to restrain violation or to recover damages.

3.SEVERABILITY: Invalidation of any one or more of these covenants by Judgment or Court Order shall in no way effect any of the other provisions that shall remain in full force and effect.

4.LAND USE: No lot shall be used except for residential purposes, no commercial or retail business of any kind permitted. No poultry houses, house trailers or mobile homes.

5.BUILDING LOCATION: There shall be at least a 30 foot set back from the front tract line or diagonal road way and 10 feet from the property line of any adjoining property owner.

6.DWELLING SIZE: No residence shall be erected on any lot unless such structure contains not less than 1700 square feet of living area unless approved by

Woodson Development, Inc or committee, and Woodson Development, Inc or committee must approve all house designs. For the purpose of the covenant, eaves, steps and open porches shall not be considered as a part of the building, provided however, that this shall not be construed to permit any portion of a building on a lot to encroach upon anothers lot. Said dwelling shall be of permanent structure and completed within 12 months of start of construction. Construction to start within 180 days of lots purchase, unless approved by Woodson Development, Inc or committee. All outbuildings must match the side of the home; no metal buildings; minimum $5,000 in landscaping; no open carport and garage must be attached to home.

7.LIVESTOCK AND POULTRY: no animals, livestock or poultry shall be raised, bred or kept on any lot except dogs, cats, calves or horses kept as pets only for pleasure purposes providing that they are not kept, bred, or maintained for any commercial purposes.

8.SIGNS: No sign of any kind shall be displayed to the public view on any lot except one professional sign of not more than one square foot, advertising the property for sale, rent or signs used by the builder to advertise the property during the construction and sales period.

9.GARBAGE AND REFUSE DISPOSAL: No parcel, tract or lot shall be used or maintained as a dumping ground for rubbish, trash, garbage, waste material, old cars or equipment. All incinerators or other equipment for the storage and /or disposal of such material shall be kept in a clean sanitary condition.

10.WATER SUPPLY AND SEWAGE DISPOSAL: Water supply, Septic tanks and / or sewer disposal systems and distribution fields and areas, shall be constructed in strict accordance with the requirements for the State, County and Health Department Regulations or Codes.

11.DRIVEWAYS: Connecting to the existing roads for driveways from the individual lots will be the responsibility of the individual lot owner, and is necessary, driveways shall be culverted in sufficient size to carry and drain away the normal accumulation of surface water.

12.OBSTRUCTIONS: No signs, fences, walls, hedges or shrubs shall be placed or planted which will obstruct sight lines entering or exiting main roadway.

13.TRACT AREA: Lot area shall be designated by the survey and no lot, tract or parcel shall be reduced in size or further subdivided. Lots will be limited to one single-family dwelling.

14.EASEMENTS: Easements for installation and maintenance of utilities and / or drainage are reserved as shown on survey. Within the Easements, no structures, planting or other material shall be placed or permitted to remain which may interfere with the installation and maintenance of utilities.

The more adventuresome can also enjoy the challenges of backpacking, rock climbing, rappelling, hang gliding, biking, mountain biking, and ATV trail adventure. The new, high tech sport of geocaching can be enjoyed here, too.

The mountain has long been an outdoor laboratory for nature study. Today, park interpreters present a wide variety of nature programs for the education and enjoyment of visitors and school groups that visit the park.

The park's magnificent 60-room Lodge at Mount Magazine and 13 park cabins opened in May 2006. Featuring breathtaking views from Mount Magazine's south bluff, these first-class facilities carry on the mountain's lodging tradition that has been a part of the recreational legacy of Mount Magazine since 1900, one most recently carried forward by the U.S. Forest Service lodge that operated on the mountain, at the same site, from the 1940s until it was destroyed by fire in 1971.

Arkansas State Parks has developed Mount Magazine State Park in the Magazine District of the Ozark National Forest on 2,234 acres of national forest lands atop the mountain through a special use permit from the USDA Forest Service. Mount Magazine is one of Arkansas's 52 state parks administered by the State Parks Division of the Arkansas Department of Parks and Tourism. Here at Mount Magazine, the combined resources of the Forest Service and Arkansas State Parks ensure the protection of the mountain's natural resources while providing outstanding recreational offerings and lodging facilities for visitors. Mount Magazine State Park is a microcosm of why Arkansas-The Natural State is such a special experience for those who seek quality outdoor experiences.
