Tract 1 has a gas well that furnishes gas for the home on tract 2. Tract 1 sells subject to this arrangement plus an easement from the well to the home on tract 2 across tract 1 as shown on the survey. The buyer of tract 1 will have the right to tap onto this well to receive gas for a single residential structure. Any cost in this effort will be born by the buyer of tract 1.
Once this tap-on occurs, any cost involved in maintaining and serving this well will be born equally by the buyers of tracts 1 and 2.
The sellers of these tracts and their agents/auctioneers are making no warranties as to the amount of gas that may be extracted from this well or the length of time that it will produce gas.
